1. Agreement to Terms
By accessing this website, purchasing any service, signing a proposal, or entering into any agreement with Social Currency Agency LLC ("SCA," "we," "us," or "our"), you ("Client") agree to be bound by these Terms of Service. If you do not agree, do not use our services.
These Terms apply to all clients, visitors, and anyone who interacts with SCA in a professional capacity, regardless of how services were initiated (direct purchase, discovery call, referral, or otherwise).
2. Services Provided
Social Currency Agency offers digital marketing and growth services including, but not limited to:
Social media growth strategy and content management
Organic views, engagement, and audience development campaigns
Editorial press coverage and PR article placements
Artist and entrepreneur brand development
Influencer and creator outreach campaigns
Marketing consultation and strategy sessions
Financing referrals for marketing services (see Section 10)
Custom service packages as outlined in individual proposals
Specific deliverables, timelines, and scope are defined in the proposal or agreement signed by both parties. In the event of any conflict between these Terms and a signed proposal, the proposal governs.
3. Client Responsibilities
To enable SCA to deliver services effectively, you agree to:
Provide accurate account access, credentials, and assets in a timely manner
Respond to communications within 3 business days unless otherwise agreed
Ensure all content and intellectual property you provide is owned by you or properly licensed
Not engage competing agencies for the same service scope during an active campaign without prior written notice
Maintain compliance with the terms of all third-party platforms associated with your campaign
SCA is not liable for any delays, underperformance, or platform penalties arising from a Client's failure to fulfill these responsibilities.
4. Payments & Refunds
All fees are outlined in your signed proposal or invoice. Unless otherwise stated:
Payment is due before campaign activation or service delivery begins
Monthly retainers are billed in advance on the agreed billing date
Late payments beyond 7 days may result in a pause or suspension of services
A 3% processing fee applies to all credit card payments
Strict No-Refund Policy: All sales are final. SCA maintains a strict no-refund policy on all services. Due to the nature of digital marketing — where labor, strategy, and third-party resources are deployed immediately upon payment — no refunds will be issued under any circumstances once payment has been processed.
Strict No-Chargeback Policy: By purchasing any SCA service, you expressly agree not to initiate a chargeback or payment dispute with your bank or card issuer for any reason. Filing a chargeback constitutes a breach of these Terms and will result in immediate termination of all active services, forfeiture of any work product, and referral of the outstanding balance to a collections agency. SCA reserves the right to pursue all available legal remedies in response to fraudulent chargebacks.
Subscription Cancellation: Clients on recurring monthly retainers may cancel at any time. To be eligible for cancellation before the next billing cycle, you must email support@socialcurrencyagency.org at least 3 business days before your billing date. Cancellation requests received fewer than 3 business days before the billing date will not take effect until the following billing cycle, and the upcoming charge will be processed as normal. Cancellations do not entitle the Client to a refund of any previously charged amounts.
5. Results Disclaimer
SCA provides marketing services based on proven strategies and industry experience. However, we do not guarantee specific outcomes, including but not limited to: follower counts, stream numbers, playlist placements, revenue generated, or press coverage secured.
Any projected figures shared during the sales process or in proposals are estimates based on historical data and are not contractual guarantees. Results vary depending on niche, content quality, platform algorithm changes, audience behavior, and other factors outside SCA's control.
By engaging SCA's services, you acknowledge that digital marketing involves inherent risk and that past results do not guarantee future performance.
6. Intellectual Property
All strategies, frameworks, scripts, templates, creative briefs, and proprietary systems developed by SCA remain the intellectual property of Social Currency Agency LLC and may not be reproduced, resold, or shared without written consent.
Content created specifically for a Client is licensed to the Client for use upon full payment of all outstanding invoices. SCA retains the right to reference completed work in its portfolio and marketing materials unless the Client requests otherwise in writing.
You retain full ownership of all pre-existing content, branding, music, and other intellectual property you provide to SCA.
7. Confidentiality
Both parties agree to keep confidential any non-public information shared during the course of the engagement, including but not limited to pricing, strategy documents, business data, and client lists.
SCA will not disclose your personal or business information to third parties except as required by law, necessary to deliver services, or expressly permitted by you.
8. Limitation of Liability
To the maximum extent permitted by applicable law, SCA shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from or related to the use of our services, including lost revenue, lost opportunities, platform suspensions, or data loss.
SCA's total aggregate liability to any Client for any claim shall not exceed the total fees paid by that Client in the three (3) months preceding the claim.
